Welcome to BorderFlo (the “App”), a service provided by BorderFlo Fintech Inc. (“BorderFlo”, “we”, “us” or “our”). These Terms and Conditions ("Terms") govern your access to and use of the BorderFlo website, services, and applications (collectively, the "Service"). By using the App or Services, you agree to these Terms. If you do not agree, you may not use the App or the Services.

1. Acceptance of Terms

By accessing or using BorderFlo, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you are using the App or Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Service Provided

BorderFlo provides payment processing services for international students, allowing them to manage and complete payments such as school deposit fees, application fees, WES evaluation fees, SEVIS fees, and other education-related transactions (the "Service"). Our platform is designed to facilitate secure cross-border payments directly to educational institutions and other relevant third parties.

2.1 Service Availability

The Service is typically available 24 hours a day, 365 days a year. However, there may be instances where the Service is temporarily unavailable to you or your Beneficiary. These periods of unavailability may be due to actions initiated by BorderFlo (such as scheduled maintenance, upgrades, or improvements), or events outside of our control, including but not limited to power outages, telecommunications failures, acts of war or civil unrest, natural disasters, or other force majeure events.

2.2 Transaction Limits and Delays

From time to time, BorderFlo may impose limits on the value of payments you can initiate (either on a per-transaction basis or over a set period) and the value a Beneficiary may receive. These limits are put in place to comply with legal, regulatory, and internal policy requirements. In certain cases, payments may be delayed while we verify that they adhere to the applicable laws, regulations, or BorderFlo policies.

2.3 Compliance and Security

BorderFlo reserves the right, without prior notice, to refuse to process or accept any payment that we determine may violate any laws, regulations, or our internal policies. This includes policies related to anti-money laundering, terrorist financing, fraud prevention, and other financial service abuses. If we accept a payment and later determine it may be in violation of these laws or policies, BorderFlo reserves the right to hold the payment until the matter is fully resolved.

We are committed to ensuring that all transactions made through the Service comply with international financial regulations and that payments reach the intended Beneficiaries securely. As a user, you are responsible for ensuring that all information provided during the payment process is accurate and lawful.

3. Eligibility

You must be at least 18 years old to use the App and our Services. By using the App and the Service, you represent that you are legally capable of entering into a binding contract, and you are not barred from receiving the Service under any applicable laws.

4. Account Registration

To use the Service, you must create an account with BorderFlo. When creating your account, you agree to provide accurate and complete information, including your name, email address, and payment details. You are responsible for maintaining the confidentiality of your account login information and for any activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Fees and Charges

BorderFlo charges fees for processing payments. All fees are clearly disclosed before you complete a transaction. By using the App or the Service, you agree to pay the specified fees and any applicable taxes. BorderFlo reserves the right to change its fees at any time, and we will notify users of such changes.

6. Payment Processing

BorderFlo facilitates payments by securely transmitting funds from your designated payment method (e.g., debit card, bank account) to the recipient (e.g., an educational institution or government immigration provider). Payments are typically processed within 1-3 business days. However, processing times may vary depending on the destination country, institution, and other factors outside of BorderFlo’s control.

7. Currency Exchange

If your payment involves a currency exchange, BorderFlo will convert the funds at the applicable exchange rate provided at the time of the transaction. Exchange rates fluctuate, and you acknowledge that BorderFlo is not responsible for any variations in exchange rates that may occur between the time a payment is initiated and when it is completed.

8. Cancellation, Refunds, and Error Resolution

Once a payment has been initiated through the BorderFlo App and Service, it may not be possible to cancel or reverse the transaction. Refunds will be processed only under certain conditions as determined by BorderFlo or the recipient institution. If you believe there has been an error or issue with your payment, please contact BorderFlo support immediately at support@borderflo.com.

8.1 Error Resolution and Transaction Cancellation

For error resolution, transaction cancellation, questions, complaints, or a written explanation of your rights, contact us at support@borderflo.com. Since BorderFlo credits Payments to Beneficiaries immediately, your Payments are typically not cancellable or refundable. If you believe that you sent a Payment in error, you must contact us within thirty (2) hours after initiating it at support@borderflo.com, and we will attempt to recall it.

9. User Responsibilities

  • Provide accurate and complete information in your account and transaction details.
  • Comply with all applicable laws and regulations, including those related to financial transactions and money transfers.
  • Use the Service for lawful purposes only.
  • Not engage in any fraudulent, abusive, or harmful activity related to the Service.

10. Prohibited Activities

You are prohibited from using BorderFlo for any illegal, unauthorized, or fraudulent activities, including but not limited to:

  • Money laundering, terrorist financing, or any other illegal financial activities.
  • Transferring funds that are derived from illegal activities.
  • Attempting to hack or disrupt the Service.
  • Using the Service to impersonate others or misrepresent your identity.

BorderFlo reserves the right to terminate or suspend your account if we suspect any prohibited activity.

11. Limitation of Liability

To the maximum extent permitted by law, BorderFlo shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to lost profits, data loss, or system damage, arising out of or in connection with your use of the App and the Service.

12. Termination

BorderFlo reserves the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to BorderFlo, its users, or third parties.

13. Privacy Policy

Your privacy is important to us. By using the App and the Service, you consent to the collection and use of your personal information as outlined in our Privacy Policy. We encourage you to read our Privacy Policy carefully to understand how we handle your data.

14. Intellectual Property

All content and materials on the BorderFlo website, App and related services, including but not limited to text, logos, graphics, and software, are the property of BorderFlo or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. Any unauthorized use of the Service or its content is strictly prohibited.

15. Modifications to the Terms

BorderFlo reserves the right to modify these Terms at any time. When we do, we will post the updated Terms on our website and notify users of significant changes. Your continued use of the Service after changes have been made constitutes your acceptance of the new Terms.

16. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles.
